1. Who we are and what these terms cover

These terms govern your use of the DK Sudoku mobile app (the "App"), provided by David Kuchel, trading as DK Squared Studio, Germany ("we", "us"). Contact details are in the Impressum.

You download the App and make purchases through Google Play or the Apple App Store. Their terms (the Google Play Terms of Service or Apple's Media Services Terms and Licensed Application End User License Agreement) also apply. How we handle data is described in the DK Sudoku Privacy Policy.

2. Your licence to use the App

We grant you a personal, non-exclusive, non-transferable licence to use the App for private, non-commercial purposes on devices you own or control, within the limits of the store's usage rules.

3. Free trial and unlocking the App

You can play 20 puzzles free, at any difficulty. To keep playing after that, you can unlock the full App in one of two ways. Both unlock exactly the same content. Neither includes ads.

3.3 Prices and payment

Prices are shown in the store in your local currency and include any applicable VAT. Payment is processed solely by Google or Apple. Purchases are concluded through the store and are subject to its terms, including its terms on payment and on any statutory right of withdrawal.

4. Cancelling a subscription and refunds

Refunds follow the policy of the store you bought from. You can request one from Google Play or Apple. For Google Play purchases you are also welcome to contact us, and we will look at your case. Your statutory rights as a consumer are not affected.

5. Achievements and leaderboards

Achievements and leaderboards are provided through Google Play Games Services or Apple Game Center, under Google's or Apple's terms. We do not guarantee that these services are always available. Achievements and leaderboard positions have no monetary value and cannot be exchanged.

We may remove scores or achievements that were obtained by manipulating the App, its data or the platform services, and we may reset leaderboards where necessary, for example after a scoring error.

7. Intellectual property

The App, including its puzzles, design, artwork, text and the name "DK Sudoku", is protected by copyright and other rights and belongs to us or our licensors. Open-source components are used under their own licences, which are listed in the App under About → Open-source licenses.

8. Updates and availability

We provide the updates required by law to keep the App working as described, and we may improve or change it in other updates. Some features depend on your device, operating system or platform services (such as Play Games) that we do not control.

If we ever stop offering DK Sudoku, we will stop selling subscriptions, give advance notice where reasonably possible and not charge any further renewals. The App works offline, so an installed copy keeps working.

9. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. For slight negligence, we are liable only for breaches of essential contractual obligations (obligations whose fulfilment makes proper performance of the contract possible in the first place and on which you may regularly rely), and only up to the damage typical and foreseeable for this kind of contract. Otherwise, our liability for slight negligence is excluded.

Your statutory rights in respect of defects in digital products are not affected.

10. Changes to these terms

We may update these terms, for example when the App gains new features. Changes do not apply retroactively to purchases already made. If a change significantly affects an active subscription, we will tell you in advance, and you can cancel before it applies.

11. Governing law and disputes

These terms are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, this choice of law does not deprive you of the protection of the mandatory consumer-protection rules of the country where you habitually reside.

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
