DK Elemental Mahjong Terms of Use
1. Who we are and what these terms cover
These terms govern your use of the DK Elemental Mahjong mobile app (the "App"), provided by David Kuchel, trading as DK Squared Studio, Germany ("we", "us"). Contact details are in the Impressum.
You install the App through Google Play. Its terms also apply. How we handle data is described in the DK Elemental Mahjong Privacy Policy, which is also in the App under Settings → About.
2. Your licence to use the App
We grant you a personal, non-exclusive, non-transferable licence to use the App on devices you own or control, within the limits of the store's usage rules.
3. The game
The App has no ads, and its helpers (hints, undos, shuffles and revives) are earned by playing; they are never sold. Your progress, levels, scores, ranks and helpers are kept on your device only (see the Privacy Policy). They have no monetary value and cannot be exchanged.
If we later offer a purchase in the App, the price and what it includes will be shown before you buy, payments will be handled by Google Play under its terms, and we will update these terms first. Your statutory rights are not affected.
We welcome your feedback through "Send feedback" in the App's settings.
4. Keep in mind
The App stores your progress on your device only. We run no servers and cannot restore anything you lose. Uninstalling the App, clearing its storage, or Settings → Reset progress deletes it.
5. Fair use
You may not:
- copy, extract or redistribute the App's design, artwork, tile sets, boards or other content
- decompile or modify the App, except where the law expressly allows it
6. Intellectual property
The App, including its design, artwork, tile designs, boards, text and the name "DK Elemental Mahjong", is protected by copyright and other rights and belongs to us or our licensors. Open-source components and fonts are used under their own licences, which are listed in the App under Settings → About → Open-source licences.
7. Updates and availability
We may improve or change the App in updates, for example by adding boards, levels or features. The App works offline.
8. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. For slight negligence, we are liable only for breaches of essential contractual obligations (obligations whose fulfilment makes proper performance of the contract possible in the first place and on which you may regularly rely), and only up to the damage typical and foreseeable for this kind of contract. Otherwise, our liability for slight negligence is excluded.
Your statutory rights in respect of defects in digital products are not affected.
9. Changes to these terms
We may update these terms, for example when the App gains new features. When they change, we will update their date and, for important changes, let you know in the App.
10. Governing law and disputes
These terms are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, this choice of law does not deprive you of the protection of the mandatory consumer-protection rules of the country where you habitually reside.
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
