DK Field Camera Terms of Use

Last updated: 15 October 2026

1. Who we are and what these terms cover

These terms govern your use of the DK Field Camera mobile app (the "App"), provided by David Kuchel, trading as DK Squared Studio, Germany ("we", "us"). Contact details are in the Impressum.

You install the App through Google Play (or, later, the Apple App Store). Their terms also apply. How we handle data is described in the DK Field Camera Privacy Policy, which is also in the App under Settings → About.

2. Your licence to use the App

We grant you a personal, non-exclusive, non-transferable licence to use the App on devices you own or control, within the limits of the store's usage rules. You may use the App for your work, for example to document sites, inspections and installations for your employer or your clients. Each person uses their own installed copy.

3. The pilot

This version is a pilot for invited testers. During the pilot:

A later version may offer paid features or a subscription. If so, the price and terms will be shown in the App and in the store before you can buy anything, and these terms will be updated first.

4. Your photos and your responsibility

Your photos and everything you record with them (positions, times, addresses, project details, field values, your company and your name) belong to you and stay on your device until you share or export them.

You are responsible for what you photograph, record and share. In particular:

5. Accuracy of positions, directions, times and addresses

Positions, accuracies, altitudes, directions and addresses come from your device's sensors and from location and address services. They can be wrong, sometimes by a lot, for example indoors, near buildings or with "approximate location" turned on. Every photo records the accuracy reported for its position, and an address found from an inaccurate position is marked as approximate.

The App is a documentation aid, not a surveying instrument. Check the details before relying on them for anything important, such as measurements, legal evidence or safety decisions.

6. Keep your own backups

The App stores its copies of your photos on your device only. We run no servers and cannot restore anything you lose. Uninstalling the App, or clearing its storage, deletes the App's copies; copies saved to your gallery stay. Export or back up photos that matter.

7. Fair use

You may not:

8. Intellectual property

The App, including its design, artwork, text, built-in templates and the name "DK Field Camera", is protected by copyright and other rights and belongs to us or our licensors. Open-source components are used under their own licences, which are listed in the App under Settings → About → Open-source licences.

9. Updates and availability

We may improve or change the App in updates. Some features depend on your device, operating system or services we do not control, such as the address service or Google Maps. The App's core functions (taking, stamping, storing and exporting photos) work offline.

10. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. For slight negligence, we are liable only for breaches of essential contractual obligations (obligations whose fulfilment makes proper performance of the contract possible in the first place and on which you may regularly rely), and only up to the damage typical and foreseeable for this kind of contract. Otherwise, our liability for slight negligence is excluded.

Your statutory rights in respect of defects in digital products are not affected.

11. Changes to these terms

We may update these terms, for example when the App gains new features or leaves the pilot. When they change, the App shows the new version and asks you to accept it before you continue.

12. Governing law and disputes

These terms are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, this choice of law does not deprive you of the protection of the mandatory consumer-protection rules of the country where you habitually reside.

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

13. Contact

Questions about these terms: support@dk-squared-studio.com, or "Send feedback" in the App.
